1. Acceptance of these terms

By creating an account, accessing or browsing Monoshoot, uploading product images, generating studio visuals, purchasing credit packs, or subscribing to a paid plan, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, do not access or use the platform.

Monoshoot is an AI-powered visual production studio designed for commercial product photography across Jewellery & Accessories, Clothing & Fashion, Cosmetics & Wellness / Beauty, and custom product categories. The platform enables users to upload product photos, configure scene environments, lighting, backgrounds, model attributes (such as gender, ethnicity, and skin tone), synthesize studio-grade photographs using AI models, manage generation history, and export high-resolution assets in multiple formats and aspect ratios.

2. Accounts and authentication

You may register and access your Monoshoot account using Google authentication or email-based authentication. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must provide accurate, current, and complete information during registration. You must use the platform only for lawful business, creative, or personal purposes. Monoshoot reserves the right to suspend or terminate accounts that provide misleading information, engage in abusive or unauthorized behavior, experience payment failures, or violate these terms.

3. User content and upload rights

You retain full ownership and all intellectual property rights in any product photographs, reference images, logos, trademarks, prompts, styling instructions, or other materials you upload or submit to Monoshoot ('User Content').

By uploading User Content, you represent and warrant that you own or have obtained all necessary licenses, consents, and permissions to use and authorize Monoshoot to process that content. You grant Monoshoot a limited, non-exclusive, worldwide license to process, store, format, and display your User Content solely to operate, maintain, and provide the services to you (including AI synthesis, cloud storage, export rendering, customer support, and security auditing).

You may not upload content that infringes upon third-party intellectual property rights, contains adult, pornographic, sexually explicit, or prohibited violent material, depicts minors without legal authority, promotes unlawful acts, or is designed to impersonate, deceive, or manipulate the identity or likeness of another individual or brand.

4. AI generated outputs and commercial rights

Monoshoot uses advanced generative AI models (including OpenAI image generation models) combined with proprietary Monoshoot prompt engineering and image synthesis pipelines. The studio is engineered to preserve key product details, silhouettes, and textures while rendering realistic studio backgrounds, lighting, lifestyle compositions, and human models.

Commercial Rights: Subject to your compliance with these terms and applicable third-party provider terms, Monoshoot grants you full, unrestricted commercial rights to use, reproduce, publish, display, distribute, advertise, and monetize the images generated by your account ('Generated Outputs'). You may freely use Generated Outputs for ecommerce listings (such as Shopify, Amazon, Etsy, WooCommerce), advertising campaigns, social media, lookbooks, catalogues, print media, and client projects.

Output Disclaimer: While Monoshoot strives for photographic fidelity and realistic physics, AI-generated images may occasionally contain visual imperfections, anatomical anomalies, artifacts, or lighting inaccuracies. You are responsible for inspecting and reviewing all Generated Outputs prior to publishing, printing, advertising, or relying on them. Monoshoot does not guarantee that any output is legally compliant for a specific regulated use or accepted by any third-party marketplace or advertising network.

5. Plans, limits, and credit roll-over

Monoshoot offers a Free tier and multiple paid subscription tiers (including Starter, Plus, Production Lite, and Production). Plan features may include monthly credit allowances, quality tiers (Medium, High, Ultra), watermark removal, multi-reference image uploads, high-resolution downloads, and multi-format exports (JPG, PNG, WEBP, AVIF).

Credit Roll-Over: For all active paid subscription plans, unused monthly plan credits automatically roll over into the subsequent billing cycle for as long as your paid subscription remains active and in good standing. If a paid subscription is cancelled or expires, accumulated roll-over credits remain accessible until the end of the current paid billing period.

Free tier credits represent a promotional trial allocation and do not roll over. One generation request consumes one credit upon successful rendering. Credits are not deducted for generation attempts that fail due to internal system errors or provider outages.

6. Credit packs and referral rewards

Credit Packs: Active paid subscribers may purchase one-time credit top-up packs ('Credit Packs') to add extra generations to their account balance. Credit Pack credits are billed immediately, do not expire while your account remains active, and are consumed alongside subscription credits.

Referral & Creator Programs: Monoshoot may offer referral and creator incentives where users earn bonus credits for qualifying new subscriber referrals. Referral links must be shared responsibly. Self-referrals, automated script sign-ups, deceptive marketing, spamming, or fraudulent referral schemes are strictly prohibited and will result in immediate revocation of unearned credits and potential account closure.

7. Payments, billing, and merchant of record

All paid subscriptions and credit pack purchases are processed securely through our payment partner and Merchant of Record, Dodo Payments. Monoshoot does not collect, process, or store your raw payment card or banking details.

By subscribing to a paid plan, you authorize Dodo Payments to charge your designated payment method on a recurring monthly basis until you cancel. All fees, taxes, and applicable currency rates displayed at checkout apply.

Upgrades and plan changes take effect upon payment confirmation. When upgrading, new plan limits and quality tiers are enabled immediately.

8. Cancellation and refund policy

Subscription Cancellation: You may cancel your paid subscription at any time directly from the Billing & Subscription page in your account. Upon cancellation, your subscription will not renew, and you will retain full access to your paid features and credits until the end of your current paid billing period.

Refund Policy: Refund requests for monthly subscriptions must be submitted in writing to support@monoshoot.com within 7 calendar days of the initial subscription purchase or renewal date. To be eligible for a refund, you must have used less than 10% of the plan's allocated generation credits during the billing cycle. Approved refunds are issued after deducting the prorated value of used credits and non-refundable transaction or tax processing fees.

One-Time Credit Packs: One-time credit top-up packs are digital goods that provide instant generation capability; they are non-refundable once delivered or partially consumed, except in cases of verified technical billing errors or where required by mandatory consumer protection law.

9. Account and data deletion

You may request the deletion of your account and associated personal data at any time from your Account settings by entering 'DELETE' in the confirmation dialogue.

Upon submitting a deletion request, your account enters a 30-day scheduled grace period during which you may cancel the deletion if you wish to restore access. After the 30-day period expires, your profile, authentication records, and stored generation assets will be permanently deleted from our primary databases and cloud storage, subject to statutory retention obligations for tax, billing audit, security, and fraud prevention.

10. Prohibited use and platform integrity

You agree not to use Monoshoot to: (a) generate illegal, infringing, harassing, defamatory, or non-consensual imagery; (b) upload malicious code, viruses, or harmful payloads; (c) attempt to reverse engineer, decompile, scrape, or extract source code or AI models; (d) bypass, manipulate, or circumvent credit counters, usage caps, or rate limits; (e) interfere with the security, availability, or infrastructure of Monoshoot or its partners; (f) generate, modify, transform, or otherwise create images that depict, impersonate, or materially imitate a real or identifiable individual without appropriate authorization, including public figures, celebrities, influencers, or private individuals; (g) create or facilitate deepfakes, face swaps, identity manipulation, or other synthetic media intended to misrepresent the identity or likeness of a real person; or (h) use Monoshoot to create non-consensual or deceptive synthetic representations of any real individual, including sexualized or otherwise harmful representations.

Safety and Content Screening: Monoshoot uses automated safety controls to screen user-provided instructions and generation requests for prohibited content and attempts to generate or manipulate content involving real or identifiable individuals. Requests that violate these restrictions may be rejected, and Monoshoot may suspend or terminate accounts that attempt to circumvent these safeguards.

Violation of these rules may result in immediate suspension or permanent termination of your account without notice or refund.

11. Third-party infrastructure and services

Monoshoot integrates with trusted third-party service providers to deliver the platform, including: Supabase (database, authentication, and platform data), Backblaze B2 (encrypted cloud object storage for images), OpenAI (AI image generation infrastructure), Dodo Payments (payments and merchant of record), PostHog (product analytics), and Sentry (application monitoring and error tracking).

Service availability and processing speeds may depend on the operational status of these third-party systems. Monoshoot is not liable for disruptions, delays, or policy modifications originating from third-party providers outside our direct control.

12. Disclaimers and limitation of liability

Monoshoot is provided on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and continuous uninterrupted operation.

To the maximum extent permitted by applicable law, Monoshoot, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the platform or Generated Outputs.

13. Governing law and jurisdiction

These Terms & Conditions and any disputes arising out of or relating to your use of Monoshoot shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

Any legal action, suit, or proceeding arising under these terms shall be instituted exclusively in the competent courts located in India, and you consent to the personal jurisdiction and venue thereof.
